Conference on Arbitration Regime in India: In Collaboration with Shardul Amarchand Mangaldas & Co. - Saturday, July 20, 2019

INTRODUCTION

The jurisprudence on arbitration in India is changing with each passing day. In two decades since the Arbitration and Conciliation Act, 1996 taking shape, despite popular belief and an overwhelming call for improvement there was absolutely no change brought about in the law. In fact, there were two failed attempts to bring about transformation in the law in keeping with the pace of change in the international arena. Finally, the Arbitration and Conciliation (Amendment) Act, 2015 ushered in the much awaited change and since then the jurisprudence has developed at a scorching pace. As is the nature of the beast, every change in law is followed by interpretation thereof by the courts.

When the law is tested in courts one realizes that there are yet inconsistencies and lacunae which need to be addressed. Over the years, some interesting questions of law have repeatedly arisen in Indian courts and yet continue to remain a grey area. The present conference strives to provide meaningful coverage on current trends in the field of International Arbitration.

Mr. Surjendu Das, Advocate on Record, Supreme Court of India | Former Partner, Dispute Resolution and Arbitration Team, Shardul Amarchand Mangaldas & Co.

Mr. Surjendu Sankar Das practices law in Delhi as Advocate-on-Record (AOR) of the Supreme Court of India. Surjendu successfully handled numerous cases before the Supreme Court, various High Courts, Trial Courts and Tribunals. He successfully handled several complex international, domestic arbitrations and challenge / enforcement proceedings.

Mr. Surjendu has significant experience as an advocate in complex trials, appellate matters, writ matters, arbitration and enforcement proceedings. He has represented wide range of Indian and foreign clients both in litigation and arbitration.

Mr. Surjendu is a former Dispute Resolution Partner of Shardul Amarchand Mangaldas & Co., New Delhi.

Mr. Gauhar Mirza, Principal Associate, Dispute Resolution and Arbitration Team, Shardul Amarchand Mangaldas & Co.

Mr. Gauhar Mirza is a Principal Associate with New Delhi office of Shardul Amarchand Mangaldas & Co. He is enrolled with Bar Council of Delhi since 2010. He is member of Delhi High Court Bar Association and Supreme Court Bar Association. Prior to joining SAM, Delhi Office, he has worked at L&L Partners (erstwhile Luthra and Luthra Law Offices) and has been a part of Shardul Amarchand Mangaldas & Co. since 2016.

Mr. Gauhar specialises in international and domestic commercial arbitration and corporate litigation. He has represented private and public corporations before various judicial forums and in ad hoc and institutional arbitrations in a wide range of disputes. He regularly represents clients in Indian court proceedings relating to arbitration. Apart from arbitration related litigation matters, he appears in various commercial civil suits, writ petitions and other misc. petitions before different judicial forums across India.

Mr. Gauhar has spoken on arbitration-related issues at various fora in India at conferences, seminars, training programmes, law schools and workshops.

Ms. Avlokita Rajvi, Senior Associate, Dispute Resolution, Shardul Amarchand Mangaldas & Co.

Ms. Avlokita Rajvi specializes in Dispute Resolution. In the course of her professional career, she has had exposure to various forums including the Supreme Court of India, the Delhi High Court, the Appellate Tribunal for Electricity, New Delhi, the Debt Recovery Tribunal, New Delhi, National Company Law Appellate Tribunal, New Delhi. She was also involved in consultations with the Ministry of Labour and Employment and Ministry of Home Affairs for certain advisory work. Her major research work has been in areas of law like arbitration, corporate litigation, civil procedure, right to information, banking regulation, takeover regulations, electricity laws, consumer laws.

One of the major matters she worked for, involved representation before the Supreme Court of India in the recent landmark judgment wherein the Reserve Bank of India was directed to disclose information related to banks in public interest. Other significant matters before the Supreme Court involved working for clients like Betamax Limited and Burren Energy India Limited. She is also representing Sardar Sarovar Narmada Nigam Limited before the Appellate Tribunal for Electricity, New Delhi. Her exposure in arbitration is attributable to her engagement in matters before arbitral tribunals, the Supreme Court and Delhi High Court, representing clients like Bharat Heavy Electricals Limited, JOGPL Pvt. Ltd., GE T&D India Ltd., SRS Investments Bengal Tiger Limited etc.
